1.3 “Free Account” means a user account with zero subscription fee that is subject to the usage limits described in Section 3.
1.4 “Paid Subscription” means any monthly or annual subscription plan for which you pay a recurring fee.
1.5 “Content” means text, images, audio, video, code, data, or other materials that you upload, generate, or otherwise submit through our Services.

2. Nature of the Free Account
2.1 When you sign up for a Free Account, you receive a default package with the following monthly limits:
Word generation: 1,000 words
Image generation: 10 images
Audio processing (“minutes”): 10 minutes
Character processing: 10,000 characters
2.2 Free Accounts incur no subscription fee and auto-renew monthly. Any usage beyond these limits requires upgrading to a Paid Subscription.

3. Registration and Account Security
3.1 You must be at least 13 years old to use our Services. If between 13 and 18, you must have parental or guardian consent.
3.2 You are responsible for providing a valid email address and for maintaining the confidentiality of your account credentials.
3.3 You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use; Prohibited Conduct
4.1 You agree to use the Services only for lawful purposes and in compliance with all applicable laws. You may not use the Services to:
Create, upload, or distribute unlawful, fraudulent, harassing, abusive, defamatory, obscene, or indecent content
Generate or facilitate creation of pornography (including with minors), hate speech, or extremist propaganda
Promote violence, self-harm, or the manufacture of harmful weapons
Infringe on the intellectual property, privacy, or publicity rights of others
Violate any export control, import, or sanctions laws or regulations
Engage in phishing, spamming, or unsolicited marketing
Train any external AI or machine-learning model using content or data derived from our Services
4.2 We reserve the right to monitor usage, remove or refuse to publish any Content that violates these Terms, and report unlawful behavior to law enforcement.

5. Intellectual Property
5.1 All underlying software, models, and documentation provided by AiCanada are our sole and exclusive property (or the property of our licensors).
5.2 You retain ownership of your Input Data and any original Content you generate. By using our Services, you grant AiCanada a worldwide, royalty-free, perpetual license to host, store, and display your Content as necessary to provide the Services.

6. Paid Subscriptions & Billing
6.1 Paid Subscriptions automatically renew at the end of each billing cycle. You must cancel at least 48 hours before renewal to avoid being charged for the next period.
6.2 You agree to provide and maintain valid payment information.

7. Refund Policy
We match the refund terms offered by our leading competitors:
7.1 Monthly Subscriptions: Non-refundable once billed.
7.2 Annual Subscriptions: Eligible for a full refund if you request it within 14 days of initial purchase. After 14 days, no refunds will be issued, though you may cancel to prevent future renewals.
7.3 To request a refund, email support@aicanada.net with your account details and reason for the request.

8. Suspension & Termination
8.1 We may suspend or terminate your access to the Services, without notice, if you breach these Terms or engage in prohibited conduct.
8.2 Upon termination, your Free Account and any associated Content may be deleted or made inaccessible.

9. Disclaimers & Limitation of Liability
9.1 The Services are provided “as is” without warranties of any kind, either express or implied.
9.2 To the maximum extent permitted by law, AiCanada’s total liability for any claim arising out of or relating to these Terms or the Services is limited to the amount you paid in the month preceding the event giving rise to liability (or, for Free Accounts, CAD 10).
9.3 We are not liable for any indirect, incidental, consequential, or punitive damages.

10. Governing Law & Dispute Resolution
10.1 These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada.
10.2 Any dispute arising out of these Terms will be resolved in the courts of Alberta Canada.

11. Changes to These Terms
11.1 We may modify these Terms from time to time. We will notify you by posting the updated Terms on our website and updating the “Last Updated” date. Continued use of the Services after such changes constitutes acceptance of the new Terms.
